WAIVER OF LIABILITY

“Remote Passages, a division of Inter Island Excursions Ltd.,* agrees to provide, to the best of its ability, seaworthy vessels and experienced and responsible crew for the described expedition.  In consideration of taking part in this expedition, Participants agree and recognize: 

(1)  There are inherent risks in marine expeditions, for example falling overboard, falling down or being injured due to boat motion, or contracting an infectious agent during the course of your registration and/or participation in an expedition.

(2) Relevant medical conditions (such as back or neck problems, heart conditions, pregnancy or osteoporosis, or if you have fever, chills, cough, shortness of breath, muscle aches, headache or sore throat,  or have tested positive for COVID-19 in the 5 days prior to departure) must be disclosed to Remote Passages prior to signing this waiver.

(3) Remote Passages shall not be liable for any damage to person or property, loss, injury, illness, expense, or loss of life that may be suffered by the Participants including that caused by negligence on the part of Remote Passages or by vessel condition, before, during or after this expedition.   (4) Participants will pay the cost of any emergency evacuation of their person and belongings that may become necessary, and any damage Participants may cause to the property of a third party.  (5) This agreement and all services related thereto are governed by the laws of Canada and all actions against Remote Passages must be brought in a Court of competent jurisdiction in British Columbia, and no other.   (6) Parents and legal guardians of any Participants under the age of 19 agree to be bound by the terms set forth herein.  (7) The Participant, and the Participant’s parent or legal guardian, further agrees to fully hold harmless and fully indemnify Remote Passages with respect to any claims that may be brought against it as a result of the Participant taking part in this expedition.  (8) All references to Remote Passages, includes Inter Island Excursions Ltd., their officers, directors, employees, servants, agents, subcontractors and vessels.”

Having  read this Waiver of Liability, you understand  that there are inherent risks in your selected marine activity, and that you will be required to sign this or a similar Waiver (on site) prior to joining an activity with Remote Passages.

* Reserves right  to refuse passage, cancel departures, substitute vessels for any reason.
